Terms of Service

1. Acceptance of Terms

By accessing or using Breaker Labs ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.

2. Account Terms

• You must provide a valid email address to create an account.
• You are responsible for maintaining the security of your account and password.
• You are responsible for all activity that occurs under your account.
• You must be 18 years or older to use the Service.
• One person or legal entity may not maintain more than one account.

3. Subscriptions & Billing

The Service offers a free 7-day trial. After the trial period, a paid subscription is required to access Pro features. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription rate.

• Payment is processed securely by Stripe. We do not store your credit card information.
• Subscription fees are billed in advance on a monthly basis.
• You may cancel your subscription at any time from your Billing page.
• Upon cancellation, your subscription remains active until the end of the current billing period.

5. Cancellation

You can cancel your subscription at any time through the Billing page in your dashboard. After cancellation, all features will remain available until the end of your current billing period. Once the billing period ends, your widgets will no longer function.

6. Acceptable Use

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service for any illegal, fraudulent, abusive, or unauthorized purpose.
• Upload or transmit content that is unlawful, harmful, defamatory, or infringes the rights of another person.
• Attempt to gain unauthorized access to the Service, another user's account, or any related system or network.
• Interfere with, disrupt, damage, overload, or impair the Service.
• Circumvent any access restriction, subscription requirement, security measure, usage limit, or technical protection.
• Introduce viruses, malware, or other harmful code.
• Use bots, scripts, crawlers, or scraping tools to access or extract information from the Service without our written permission.
• Assist or permit another person to do any of the above.

7. Intellectual Property Rights

The Service and the materials we create or provide — including our software, source and object code, widgets, overlays, APIs, interfaces, layouts, designs, animations, graphics, logos, trademarks, written content, documentation, and templates (together, the "Breaker Labs Materials") — are owned by Breaker Labs or its licensors and are protected by copyright, trademark, and other applicable intellectual property laws.

Subject to your compliance with these Terms and payment of any applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable right to access and use the Service for its intended purpose. No ownership rights in the Breaker Labs Materials are transferred to you, and all rights not expressly granted are reserved.

8. Prohibited Copying

Unless we have given you prior written permission, you must not, directly or indirectly:

• Copy, reproduce, republish, distribute, sell, sublicense, modify, adapt, or create derivative works from the Breaker Labs Materials.
• Copy or reproduce all or a substantial part of our original website content, software, interfaces, widgets, overlays, animations, graphics, documentation, or designs.
• Reverse engineer, decompile, disassemble, or attempt to derive the source code or non-public structure of the Service, except to the extent applicable law expressly permits despite this restriction.
• Frame, mirror, embed, or host any portion of the Service on another website, application, or platform.
• Systematically scrape, download, extract, index, or collect the Breaker Labs Materials.
• Use the Breaker Labs Materials to build, train, or operate a competing product or service.
• Remove, conceal, or alter any copyright, trademark, or other proprietary notice.
• Use the Breaker Labs name, logo, or branding, or any confusingly similar identifier, without our written permission.
• Represent that another product or business is affiliated with or endorsed by Breaker Labs when it is not.
• Assist or permit another person to do any of the above.

Nothing in this section restricts any right that cannot lawfully be excluded or limited, including any applicable fair dealing rights.

9. Your Content

You retain ownership of the logos, images, branding, text, and other content you upload to the Service. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and transmit that content only as reasonably necessary to provide, maintain, and secure the Service for you.

You confirm that you own or have the rights necessary to upload and use that content, and that it does not infringe another person's rights.

10. Enforcement

If we reasonably believe Sections 6, 7, or 8 have been violated, we may suspend or terminate the account involved, revoke access to the Service, require the infringing material to be removed, issue infringement notices, and pursue any remedy available to us under contract or applicable law.

11. Limitation of Liability

The Service is provided on an "as is" and "as available" basis. Breaker Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service, including but not limited to loss of profits, data, or business opportunities.

12. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we determine violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.
